Summary
This position is located within the Wage and Hour Division (WHD), the Office of Policy (OP), Division of Fair Labor Standards Act and Child Labor (FLSA-CL). The mission of WHD is to plan, develop and administer programs to provide for the execution of the Department's responsibilities under FLSA and other Acts and Statutes.
Duties
Help
As a Wage and Hour Specialist you will perform the following duties which are not all-inclusive:
- Prepares educational, promotional, and explanatory materials; prepares responses to inquiries from employers, employees, unions, business associations, other government officials, and members of Congress regarding program enforcement guidelines and interpretations, and responses to requests under the Freedom of Information Act, and provides technical input for speeches.
- Reviews program policies, regulations, and other guideline materials for currency, relevance, and sufficiency; drafts new or revised program policies, regulations and other guideline materials to implement new or amended statutory provisions or to reflect policy changes.
- Provides direct feedback and authoritative interpretations to the field and external interested parties on program policies, regulations, and other guidelines, as well as through the Field Operations Handbook; drafts interpretations and opinions for the signature of the WHD Administrator.
- Serves as liaison with WHD Regional and District Office officials regarding field enforcement policies and procedures relating to the conduct of investigations; provides technical expertise to WHD Regional and District Office officials regarding the application of regulations and interpretations.
- Analyzes, develops, and recommends policy options for implementation within WHD National Office and by nationwide field staff; develops and coordinates efforts to provide a uniform and consistent approach for resolution of statute violations.
- Coordinates with the Office of the Solicitor (SOL) in obtaining advice on legal matters arising during the interpretation, enforcement, and administration of statute, as well as with appropriate legislative proposals and litigation priorities. Also ensures that documents setting out overall enforcement policies, regulations, procedures, etc., are legally correct.

Qualifications
For GS-14 Applicants must have 52 weeks of specialized experience equivalent to at least the next lower grade level, GS-13 in the Federal Service.
This position has an Individual Occupational Requirement (IOR). In addition to meeting the Specialized Experience below, the applicant must also meet the IOR in order to be found qualified.
Must Possess at least TWO of the following THREE specialized criteria requirements:
- General knowledge of Federal wage and hour labor laws, industrial occupations, wage scales, employment practices, or salary and wage administration practices.
- Skill in analyzing written/verbal information and numerical data and making decisions on issues based on interviews, records review, reconstruction of missing or fraudulent records and applying legal or regulatory provisions, precedents, and principles to specific investigative matters.
- Skill in personal contacts requiring the ability to explain requirements or rights and obtain information and cooperation from people with diverse backgrounds and levels of understanding, reconcile conflicting interests, and persuade others to comply voluntarily with requirements.
About the Job
In addition to the criteria specified above applicants must have knowledge of and ability to apply the provisions of Federal wage and hour labor laws pertaining to wages, hours of work, or related conditions of employment.
Examples of qualifying specialized experience include
- Developing, interpreting, or applying policies, procedures, and operating standards in determining compliance for an organization or government-based program.
- Conducting interviews and providing information about laws and/or regulations.
- Industrial personnel or salary and wage administration or responsible work in a certified public accounting firm.
- Analyzing or applying labor legislation.
- Reviewing and evaluating operations and procedures through analysis, audits, or surveillance inspections.
- Federal, State, or self-regulatory agency work involving obtaining compliance with appropriate program requirements.
In addition to the criteria specified above applicants must have have 52 weeks of specialized experience equivalent to at least the next lower grade level GS-13 in the Federal Service.
Specialized Experience is the experience that equipped the applicant with the particular knowledge, skills, and abilities (KSA's) to perform the duties of the position successfully, and that is typically in or related to the position to be filled. To be creditable, specialized experience must have been equivalent to at least the next lower grade level.
Qualifying specialized experience for GS-14 includes
- Experience preparing and revising various Wage and Hour documents that explain Fair Labor Standard Act (FLSA) enforcement policies and procedures in response to legislative or judicial action.
- Experience utilizing compliance practices, procedures, and techniques, as well as an in-depth understanding of top management thinking on the WHD programs to prepare, revise, or interpret opinion letters and regulations and other Wage and Hour policy documents.
- Experience developing and drafting new or revised FLSA enforcement policies and procedures and other guideline materials to implement new or amended statutory provisions or to reflect policy changes.
- Experience developing guidance for investigators that allows the agency to fully implement new or amended policies concerning enforcement of labor standards under the FLSA.
Education
There is no education substitution for specialized experience at this grade level.

This position is inside the bargaining unit. If the duty location is within the Washington, D.C. metropolitan area, the position will be included in the Local 12, AFGE bargaining unit. If the duty location is outside the Washington, D.C. metropolitan area, the position will be included in the NCFLL bargaining unit.
